NUFURN PTY LTD – GLADIATOR & WIMBLEDON CHAIR - WARRANTY

 NUFURN PTY LTD MAKES THE FOLLOWING TWO WARRANTIES TO THE ORIGINAL PURCHASERS OF ITS Gladiator Chair (the “product”).

 Full One-Year Warranty

Subject to the limitations set forth below, we warrant that the product is free from defects in material and workmanship for a period of one year from date of delivery to you of the Product. The product will be repaired or replaced, at the discretion of Nufurn. These services do not extend beyond the warranty period. Product must be returned in a hygienic condition to Nufurn Head Office in Sydney. The warranty only covers the product. Reimbursements for shipping or freight are excluded.  Notice for any defects need to be communicated to Nufurn in writing within 7 days of the defect occurring.

 Limited Ten-Year Warranty for Gladiator Chair

Subject to the limitations set forth below, after one year, for the next nine (9) years, we will repair or replace, at our option, the seat and the back legs of the product if Nufurn deems any such part defective in material or workmanship under normal wear and tear conditions. In the event of damage or failure of the Product seat or back leg(s) of the Product, you must NUFURN PTY LTD in writing and return the defective part to NUFURN PTY LTD within 7 days of detection of the defect. 

 Limitations

The above warranties shall not apply to any part of a product, which in the reasonable judgment of NUFURN PTY LTD has been subjected to misuse, negligent handling, alteration, misapplication, accident or maltreatment. The warranty does not cover claims relating to normal wear and tear such as surface or material wear, seam wear, tabletop wear, scuff marks, paint or powder coat scratching or chipping, bolt, screw or rivet loosening, wood splitting or breakages or rust.   Excessive or prolonged exposure to sunlight and extreme freezing weather can shorten the normal life of the Product. The above warranties do not cover damage from excessive or prolonged exposure to sunlight or extreme freezing temperature to elements such as wind, rain, snow, ice or other extreme weather conditions or acts of God.

You are responsible for the cost of shipping any defective product or part to and from the NUFURN PTY LTD warehouse.  This warranty will be void if you have defaulted in payment or any other obligation owed to NUFURN PTY LTD.

The above warranties and NUFURN PTY LTD’s obligations hereunder are exclusive and in lieu of, and you expressly waive, all other warranties, verbal or written, express or implied, including but not limited to any warranty of merchant ability or fitness for a particular purpose. We accept no obligations or liabilities for consequential or incidental damages arising out of or in connection with the use or performance of the product or other direct or indirect damages with respect to loss of property, revenues or profit, or for removal, installation or re-installation. No other representative or person is authorized to offer any other warranty or assume any other liabilities on behalf of NUFURN PTY LTD.

Sole Terms:

These terms and conditions constitute the full understanding and the entire agreement between the parties in regard to the subject matter here or unless hereafter made in writing and signed by the party to be bound.

 Risk of Loss:

Our Invoice to you for will show separately, the cost of product(s), freight and any other charges. However, you assume all risk of loss or damage to the product, once we have made delivery to the carrier for shipment to you, regardless of the terms of payment, or the form of bill of lading, or the mode of shipment. 

 Goods Damaged in Transit:

1) Despite your assumption of the risk of loss and damage of goods in transit, NUFURN PTY LTD will review claims of loss on concealed damages. All claims must be made in writing.

2) Any concealed damages must be reported within 48 hours of detection in order to file a claim. 

3) In the event of a concealed damage claim, NUFURN PTY LTD may negotiate a partial payment to help cover the loss. 

4) NUFURN PTY LTD does not negotiate partial payments for claims of NON-concealed damages. However, you should be aware that damages need to be noted at the time of delivery of goods and noted on the delivery document, for NUFURN PTY LTD to be able to make a claim with the relevant logistic company.
